Terms and conditions of sale

1. Seller and scope
The website wisecartshop.com is operated by João Ribeiro, sole proprietorship, Route Principale 100, 1642 Sorens, Switzerland ("WiseCartShop"), email: shopsixshop@outlook.com. These terms apply to all orders placed on this website by consumers living in Switzerland, France, Belgium, Luxembourg or Monaco.

2. Products
We describe our products as accurately as possible. Colours may vary slightly depending on your screen. Products are shipped directly by our suppliers from abroad, mostly from China.

3. Orders and conclusion of the contract
The contract is concluded when we send the order confirmation email. If a product is unavailable or in case of an obvious pricing error, we may cancel the order; any amount paid is then refunded in full.

4. Prices
Prices are shown in the currency of the delivery country: Swiss francs (CHF) for Switzerland and euros (EUR) for France, Belgium, Luxembourg and Monaco. WiseCartShop is not registered for VAT and does not charge VAT. Shipping is free to all these countries. As parcels are shipped from outside Switzerland and the European Union, the carrier may collect import VAT or customs charges on delivery; these are paid by the customer.

5. Payment
Payment is made when placing the order, using the payment methods offered on the website.

6. Delivery
Delivery times stated in our shipping policy are estimates. Risk passes to the customer when the parcel is delivered to their address. If an order has not been delivered within 30 days after the maximum delivery time stated, the customer may cancel the order and receive a full refund.

7. Right of withdrawal for customers in France, Belgium, Luxembourg and Monaco
You may withdraw from the contract within 14 days without giving any reason. The withdrawal period ends 14 days after the day on which you, or a third party you designate, take physical possession of the goods (for an order delivered in several parcels: the last parcel). To exercise this right, inform us by a clear statement, for example by email to shopsixshop@outlook.com or by post to the address above. You may use the model withdrawal form in our refund policy, but you are not required to. Sending your statement before the period expires is sufficient.
Effects of withdrawal: we refund all payments received from you, including standard delivery costs, without undue delay and at the latest within 14 days from the day we receive your withdrawal, using the same payment method. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them, whichever is earlier. You must send the goods back within 14 days after informing us. You bear the direct cost of returning the goods. You are only liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Exception: the right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed after delivery.

8. Returns for customers in Switzerland
Swiss law does not provide a statutory right of withdrawal for online purchases. WiseCartShop grants all customers a voluntary 30-day return right under its refund policy. For customers in the EU and Monaco, this voluntary right is in addition to the statutory right of withdrawal and does not restrict it.

9. Legal guarantee
All customers benefit from a legal guarantee of two years from delivery for defects and lack of conformity: in Switzerland under art. 197 ff. of the Swiss Code of Obligations; in France under the legal guarantee of conformity (art. L217-3 ff. of the Consumer Code) and the guarantee against hidden defects (art. 1641 ff. of the Civil Code); in Belgium, Luxembourg and Monaco under the legal guarantee provided by national law. If a product is defective, damaged or not as described, contact us with a photo: we replace the product or, if replacement is not possible or you prefer, refund it, at no cost to you.

10. Liability
Our liability is limited to direct damage, except in cases of intent or gross negligence and except where mandatory law provides otherwise. Liability under product liability law remains reserved.

11. Personal data
The processing of personal data is described in our privacy policy.

12. Applicable law, disputes and jurisdiction
These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer living in the EU or Monaco, you also keep the protection of the mandatory provisions of the law of your country of residence. In case of a problem, please contact us first at shopsixshop@outlook.com; we will try to find an amicable solution. A consumer may bring proceedings before the courts at their place of residence or at the seller's address.
